Draft standard family orders distributed for comment
First batch, including financial remedy orders, released
The President of the Family Division has distributed for discussion and comment the first batch of proposed standard for orders produced by Mr Justice Mostyn’s working group. The draft orders can be found here.
Sir James Munby has previously said in his View from the President’s Chambersthat it is intended that the orders will be finalised and introduced in time for the new Family Court in April 2014. The rationale was explained by the President:
“[G]iven the time and money that is currently wasted in the process of drafting orders that could, and therefore should, be standardised, the arguments in favour of standardisation seem to me to be clear.
…. I intend that the standardised orders will be available to everyone electronically. The use of standard orders produced at the press of a button will obviate the need for drafts from counsel and solicitors scribbled out in the corridor.”
The first batch of draft forms comprises those relating to:
- Financial remedy orders and Part IV
- Forced marriage and
- Reporting restriction orders.
